Terms of Service

By accessing or using Daily Drive Sourcing ("the Platform"), you agree to be bound by these Terms of Service and all applicable laws and regulations of the Republic of Kenya. If you do not agree with any of these terms, you are prohibited from using this Platform. These terms apply to all users — buyers, sellers, and visitors.

You must be at least 18 years old to use this Platform. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Not use the Platform for any unlawful purpose
• Not list counterfeit, stolen, or prohibited goods
• Not attempt to defraud buyers, sellers, or the Platform
• Not reverse-engineer, scrape, or abuse Platform systems

We reserve the right to suspend or terminate accounts that violate these rules without prior notice.

As a buyer you agree to:

• Only initiate purchases for items you genuinely intend to buy
• Make payment promptly once an order is placed
• Confirm delivery honestly — confirming delivery releases escrow to the seller
• Raise disputes within 48 hours of delivery if the item is not as described
• Not attempt to claim refunds for genuine items accurately described by the seller

As a seller you agree to:

• Submit genuine ID documents for verification before listing
• List only parts you actually have in your possession
• Describe items accurately, including condition, compatibility, and any defects
• Ship orders within 3 business days of payment confirmation
• Provide tracking information or arrange collection as agreed
• Not list the same part in multiple simultaneous transactions
• Accept that your payout is released only after the buyer confirms delivery

All payments on the Platform are processed through M-Pesa and held in escrow until delivery is confirmed by the buyer. This protects both parties:

• Buyer funds are not released to the seller until the buyer confirms receipt
• If delivery is not confirmed within 7 days, the Platform will investigate
• Refunds are issued to the buyer's M-Pesa in the event of a verified dispute
• The Platform deducts a service fee from each completed transaction before disbursing to the seller

We do not store M-Pesa credentials or payment card details.

You retain ownership of content you post. By posting listings, descriptions, and images, you grant Daily Drive Sourcing a non-exclusive, royalty-free licence to display, reproduce, and promote that content on the Platform and in marketing materials.

We reserve the right to remove any listing that:

• Is inaccurate or misleading
• Violates Kenyan law
• Relates to counterfeit or stolen goods
• Is flagged by multiple buyers for fraud

If a buyer and seller cannot resolve a dispute, either party may escalate to the Platform within 7 days of the delivery date. Our admin team will review evidence from both sides and make a binding decision. Outcomes may include:

• Full refund to buyer
• Partial refund
• Release of funds to seller
• Account suspension

The Platform's decision is final. We are not liable for losses arising from disputes between users.

The Daily Drive Sourcing name, logo, design, and platform code are proprietary. You may not copy, reproduce, or use them without written permission. Seller listings belong to the seller but are licenced to the Platform for display purposes.

To the maximum extent permitted by Kenyan law, Daily Drive Sourcing is not liable for:

• Loss or damage arising from user-to-user transactions
• Parts that are incompatible despite seller description
• Delays in delivery caused by third-party logistics
• Platform downtime or data loss

Our liability to any user is limited to the value of the disputed transaction.

These Terms are governed by the laws of the Republic of Kenya. Any disputes arising from use of the Platform shall be resolved under the jurisdiction of Kenyan courts, specifically the courts of Nairobi County.

We may update these Terms from time to time. Changes take effect 14 days after posting on this page. Continued use of the Platform after that date constitutes acceptance of the updated Terms. We will notify registered users of material changes by email.
